Informed Consent for Telehealth Services

At LifeRx.md, we're proud to launch our new products hosted at LifeRx.md alongside our existing weight loss services. This Informed Consent for Telehealth Services governs all your interactions with us, including any new offerings.

IMPORTANT NOTICE REGARDING MEDICAL EMERGENCIES

Our providers do not address medical emergencies. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency room or urgent care immediately. 1. Definitions

  • "Healthcare Services" means the clinical and medical services provided to you by Providers through the Platform.
  • "HIPAA" refers to the Health Insurance Portability and Accountability Act of 1996 and its implementing regulations.
  • "Laboratory Services" means diagnostic testing services ordered by a Provider and performed by Third-Party Laboratories.
  • "LifeRx.md" or "MSO" refers to LifeRx.md, LLC, a management services organization providing non-clinical support.
  • "Medical Group" or "Medical Group Entities" refers to the professional entities that employ/contract Providers and are independent from LifeRx.md.
  • "HIPAA Notice of Privacy Practices" means the notice describing PHI use/disclosure and your rights.
  • "Pharmacy Partners" means licensed pharmacies with which LifeRx.md has commercial arrangements for prescription fulfillment.
  • "Platform" means the technology platform operated by LifeRx.md (website, apps, tools).
  • "Protected Health Information" or "PHI" means individually identifiable health information as defined by HIPAA.
  • "Provider" means the licensed healthcare professionals who deliver Healthcare Services through the Platform.
  • "Telehealth Consent" means this notice.
  • "Telehealth Services" means delivery of Healthcare Services when Provider and patient are not in the same location using electronic means.
  • "Third-Party Laboratories" means independent clinical laboratories performing ordered tests.

2. Introduction and Purpose

Please thoroughly review this Telehealth Consent before using Healthcare Services delivered through the Platform. By registering, beginning a consultation, selecting “I Agree,” or otherwise indicating acceptance, you confirm you understand the benefits and risks of Telehealth Services and agree to receive care electronically. This operates alongside the Privacy Policy, Terms of Use, Cookie Policy, and any applicable HIPAA notice of privacy practices.

3. Corporate Structure and Provider Relationships

LifeRx.md operates as an MSO providing administrative and non-clinical support to Medical Group Entities. LifeRx.md does not provide medical or pharmacy services and does not control clinical decision-making. All Healthcare Services are rendered solely by licensed Providers employed or contracted by the Medical Group Entities, exercising independent professional judgment.

Payment through the Platform does not guarantee prescribing or dispensing; treatment decisions are at the Provider’s discretion.

4. Telehealth Services

Telehealth Services involve delivering Healthcare Services when the Provider and patient are not in the same location. Modalities may include asynchronous (store-and-forward), synchronous video/audio, interactive audio, electronic transmission of records, and device data.

5. Potential Benefits of Telehealth Services

  • Increased accessibility and convenience without travel.
  • Care at convenient times, including follow-up.
  • Efficiency in accessing consultations and treatment.
  • Reduced exposure to communicable illnesses.
  • No guarantee of any benefit; alternatives (in-person care) remain available.

6. Risks and Limitations of Telehealth Services

Clinical Limitations

  • Information provided may be insufficient for appropriate care; some conditions may not be suitable for telehealth.
  • Inability to perform in-person tests may affect diagnosis/treatment.
  • Incomplete records may cause interactions/allergic reactions.

Technical Risks

  • Technology failures (audio/video interruptions, outages, delays).
  • Platform bugs/errors could produce incorrect records or data loss.

Privacy/Security Considerations

Electronic communications carry increased privacy/security risks. While safeguards are implemented, transmissions could be intercepted by unauthorized parties.

7. Laboratory Services

Providers may order Laboratory Services via Third-Party Laboratories. Tests may have false positives/negatives/indeterminate results; equipment or protocol limitations may affect accuracy. At-home kits require proper collection/handling.

8. Pharmacy Services and Prescription Fulfillment

Prescriptions, when appropriate, may be fulfilled via Pharmacy Partners (independent entities). You may choose any pharmacy; request a transfer via support. Prescribing is at the Provider’s discretion.

9. Privacy and Data Protection

LifeRx.md and Medical Group Entities protect PHI per HIPAA and applicable state laws. PHI may be used/disclosed for treatment, payment, operations, certain administrative purposes, and as required by law. By consenting, you authorize collection/use/sharing of necessary personal/health information (including recordings/photos) to deliver services, process transactions, and meet legal obligations. See the Privacy Policy and HIPAA Notice of Privacy Practices for details.

10. Recording of Telehealth Sessions

Patients may not record Telehealth Services without documented provider approval. Unauthorized recording may end the consultation and could lead to loss of future services or reporting to law enforcement where required. Some states require all-party consent (e.g., CA, CT, FL, IL, MD, MA, MI, MT, NH, OR, PA, WA).

Providers may record sessions for quality, operations, training, research, and safety. Recordings may include two-way audio/video and related materials.

11. Patient Acknowledgments

  • You understand risks, limitations, and benefits of Telehealth Services.
  • Telehealth does not replace in-person care; providers may direct you to emergency services.
  • Increased privacy/security risk exists; both parties should be in private locations.
  • Providers may include nurse practitioners or physician assistants; you consent to treatment by licensed non-physician providers.
  • Other personnel may assist (e.g., technology/language support) and will be identified.
  • Information you provide must be accurate, true, and complete.
  • Providers may determine asynchronous care is appropriate; you agree to receive care in that manner when determined.
  • No guarantee of prescription; providers will address risks/contraindications.
  • No guarantee of benefits or improvement.
  • Technical failures beyond control may occur; you indemnify LifeRx.md, Medical Group Entities, and their representatives for delays/data loss from such failures.
  • Certain diagnostics may have defects/limitations.
  • Platform offers specific services; you may need other resources; providers may decline care if not appropriate.
  • Provider—not LifeRx.md/Medical Group Entities—is responsible for quality/appropriateness of clinical care.
  • Communication may not always be in real time; check the Platform for messages.
  • You may discuss Telehealth benefits/risks/alternatives with your Provider.
  • You have access to medical records per law and may request copies; other providers may obtain copies with consent.
  • You may request any pharmacy or laboratory.
  • LifeRx.md is a third-party beneficiary of this Telehealth Consent.

12. Right to Withdraw Consent

You may withdraw consent to Telehealth Services at any time via written notice through the Platform or support; withdrawal is effective upon receipt and does not affect prior actions taken. Providers on the Platform do not offer in-person treatment. Fees may apply if a consultation occurred before cancellation.

13. Consent to Electronic Communications

By accepting, you consent to text/email communications (scheduling, follow-up, administrative notices, feedback). This remains effective until revoked via written request. Standard email/SMS may lack dedicated healthcare encryption; you accept responsibility for your devices and accounts. Some communications may contain PHI.

15. Commercial Relationships Disclosure

LifeRx.md has commercial relationships with Pharmacy Partners and Third-Party Laboratories that may fulfill prescriptions and Laboratory Services. LifeRx.md has a financial relationship with the Medical Group Entities whose Providers deliver Healthcare Services.

You may obtain exams from other providers and prescriptions from any pharmacy of your choice by contacting support.

16. Open Payments Notice

For information on payments/transfers of value from manufacturers to physicians/teaching hospitals, visit the Open Payments database at www.openpaymentsdata.cms.gov.

This Telehealth Consent is effective as of the date you accept it and will remain in effect until withdrawn by you or updated by LifeRx.md. Continued use of the Platform after updates constitutes acceptance of the updated Telehealth Consent. The information on the Platform is not a substitute for professional medical advice; consult your licensed healthcare provider for questions or concerns.
